Contrary to what I take to be Descartes's constant position, such a rendering unwittingly transfers that function which is proper to the cognitive activity, mind is the efficient cause of its cognitive activity. We are printing, by kind permission of the Law Commission, two sections of the report of the Law Commission on injuries to unborn children. This report was the result of a request to the Law Commission by the Lord Chancellor at the time (Lord Hailsham of Saint Marylebone) to advise on `what the nature and extent of civil liability for antenatal injury should be'. The Law Commission followed its usual practice in such circumstances of consulting various bodies and obtaining expert (...) advice on the subject and then embodying the results in a working paper (Working Paper No. 47 - injuries to unborn children) published on 19 January 1973, which preceded their report (Cmnd 5709). Meanwhile a Royal Commission is considering much wider issues of civil liability for injury (including antenatal injury) but the terms of reference for the Law Commission were much narrower and confined to the position of children injured before birth. In the section relating to the present law the report makes it clear that it is probable that liability under the common law already exists. The Scottish Law Commission has also issued a report (Cmnd 5371). They were given different terms of reference and came to somewhat different conclusions. We are printing from this long report the paragraphs discussing the medical background and the summary of recommendations. As will be evident on reading the paragraphs on the medical background to injuries to the unborn child, events are moving very rapidly, particularly in the study of congenital defects and the effects of drugs but the problems of proof present great difficulty. Other causes of injury to the unborn child are better known to the general public: for example, those following the illness, infection and disease of the mother during pregnancy, injury caused in attempted termination of pregnancy and the risks resulting from the mother's condition. The summary of the recommendations sets out very clearly the legal position of the unborn child, as the Law Commission sees it, arising from injury before birth, the final conclusion being that `legislation is desirable'. These extracts from the report, apart from their intrinsic interest, lead on to the paper by Mr Kennedy and Dr Edwards in which they set out their criticisms of it, and provide quick references to the original document. The Ontology for Biomedical Investigations (OBI) is an ontology that provides terms with precisely defined meanings to describe all aspects of how investigations in the biological and medical domains are conducted. OBI re-uses ontologies that provide a representation of biomedical knowledge from the Open Biological and Biomedical Ontologies (OBO) project and adds the ability to describe how this knowledge was derived. We here describe the state of OBI and several applications that are using it, such as adding semantic expressivity to (...) existing databases, building data entry forms, and enabling interoperability between knowledge resources. OBI covers all phases of the investigation process, such as planning, execution and reporting. It represents information and material entities that participate in these processes, as well as roles and functions. Prior to OBI, it was not possible to use a single internally consistent resource that could be applied to multiple types of experiments for these applications. OBI has made this possible by creating terms for entities involved in biological and medical investigations and by importing parts of other biomedical ontologies such as GO, Chemical Entities of Biological Interest (ChEBI) and Phenotype Attribute and Trait Ontology (PATO) without altering their meaning. OBI is being used in a wide range of projects covering genomics, multi-omics, immunology, and catalogs of services. OBI has also spawned other ontologies (Information Artifact Ontology) and methods for importing parts of ontologies (Minimum information to reference an external ontology term (MIREOT)). The OBI project is an open cross-disciplinary collaborative effort, encompassing multiple research communities from around the globe. To date, OBI has created 2366 classes and 40 relations along with textual and formal definitions. The OBI Consortium maintains a web resource providing details on the people, policies, and issues being addressed in association with OBI. (shrink)

George Annas serves a critical function as an incisive commentator on the interactions between law and medicine and law and public health. Along with Alex Capron, Dena Davis, Rebecca Dresser, and Larry GostinProfessor Annas analyses legal aspects of a spectrum of medicolegal issues both in a forum and in a manner that makes them accessible and understandable to a broad community of healthcare providers. His latest book, SomeChoice, continues that valuable tradition. The bulk of the volume (17 out of 22 (...) chapters) is drawn from essays originally published as the feature of the NewEnglandJournalofMedicine. The topics include such staples of patients' rights debate as the boundaries of informed consent, authorization of medical experiments, and physician-assisted suicide. The present study is the result of two questions which arose in dealing with the Critique of Pure Reason. What is the relationship of the “Doctrine of Method” to the “Doctrine of Elements?” Does the “Doctrine of Method” tell us anything important about Kant and his philosophy? It will be the contention of this paper that the second half of the Critique relies heavily on the “Doctrine of Elements,” and is a natural expansion of the first half of the Critique. (...) In effect, this is a tentative denial of Norman Kemp Smith’s patchwork thesis. With respect to the second question mentioned above, we shall see that Kant does have a very special place for methodology in his philosophy. Words of Life is the sequel and companion to Phenomenology and the "Theological Turn," edited by Dominique Janicaud, Jean-Francois Courtine, Jean-Louis Chrétien, Michel Henry, Jean-Luc Marion, and Paul Ricoeur. In that volume, Janicaud accuses Levinas, Henry, Marion, and Chrétien of "veering" from phenomenological neutrality to a theologically inflected phenomenology. By contrast, the contributors to this collection interrogate whether phenomenology's proper starting point is agnostic or atheistic. Many hold the view that phenomenology after the theological turn may very well be true (...) both to itself and to the phenomenological "things themselves." In one way or another, all of these essays contend with the limits and expectations of phenomenology. As such, they are all concerned with what counts as "proper" phenomenology and even the very structure of phenomenology. None of them, however, is limited to such questions. Indeed, the rich tapestry that they weave tells us much about human experience. Themes such as faith, hope, love, grace, the gift, the sacraments, the words of Christ, suffering, joy, life, the call, touch, listening, wounding, and humility are woven throughout the various meditations in this volume. Possessed of a unitary academic model, he is really arguing for Aristotle's analogy of attribution. Apparently, no one of his 200 plus Jesuit contacts told him that Nastri prefer St. Thomas and his analogy of proper proportionality. The historian Daniel Boorstin spent 25 yeari!l writing his trilogy on The Americans. What emerges from this analysis? Boorstin points out that (...) Americans like ambiguity, that they function best amid flux; ambivalence becomes their proper medium. For this reason, I have accepted Nathaniel Hawthorne as our most central writer. He situates American questions within a landscape of chiaroscuro. The Jesuit experience in the United States belongs essentially to the same landscape. But today, as formerly, it remains a landscape of questions. McDonough, on the other hand, has too many certitudes, too many answers, too much high definition-what Henry Adams regards as "mere facts." Instead of illuminating the landscape from within, his study inevitably recedes into the larger ambiguity reserved for what Wallace Stevens has called, " Prologues to what is possible." As a Christian and a philosopher, Linda Trinkaus Zagzebski wants to understand why it is reasonable to affirm that we remain free despite God's infallible knowledge of our future acts. Moreover, she is not content simply to demonstrate that this affirmation involves no logical con· tradiction, for "reasonable people expect more" (p. 33) than a merely negative result. Hence the author sets herself the more ambitious task of working toward a positive solution that would explain why the compatibility of divine foreknowledge and human freedom is plausible and not a bare logical possibility. The hook sorts out recent opinions on the subject and sketches an original position that she hopes will advance the discussion. Zagzehski begins by constructing the most formidable version of the dilemma. Assuming that God is infallible and essentially omniscient, that the past has a kind of necessity that the future lacks ("accidental necessity"), and that this necessity can he transferred (in some sense) from the antecedent to the consequent of a conditional proposition, the dilemma may he stated as follows: BOOK REVIEWS (1) Necessarily, God believes at time t 1 that I will do S at t 3 if and only if I do S at t 3. (2) It is accidentally necessary at t 2 that God believes at t 1 that I will do S at t 3. (3) If (1) and (2) are true, then it is accidentally necessary at t 2 that I do Sat t 3. (4) It follows that it is accidentally necessary at t 2 that I do S at t 3. (5) But if it is accidentally necessary at t 2 that I do S at t 3, I do not do S at t 3 freely. (6) Therefore, I do not do S at t 3 freely. 715 Much of the first chapter is devoted to establishing that this form of the dilemma is more resistant to solution than any other, especially the so-called problem of future truth. Zagzebski goes on to evaluate three broad approaches to solving the dilemma. In Chapter 2 she takes up the " timelessness " solution. Its proponents, among whom the author numbers Boethius, Thomas Aquinas, Eleonore Stump, and Norman Kretzmann, negate premise (2) of the foreknowledge dilemma by contending that God is not in time. Zagzebski considers this an acceptable negative solution to the dilemma and sees in it the potential to ground a more comprehensive, positive solution. Nonetheless, she refrains from subscribing wholeheartedly to the timelessness solution because it confronts one with a dilemma at least as perplexing as the one it solves. She puts the problem this way: like the past, eternity is fixed, for it is constituted by a state of affairs about which we cannot do anything; therefore my future acts are determined no less by God's timeless knowledge than by God's foreknowing them in a strictly temporal sense. The definition of acedia presents unique conceptual problems among the eight Evagrian logismoi. Its descriptions are so complex and varied as to render the concept seemingly incoherent. This article argues that the conceptual unity of acedia has been obscured by the translation of Evagrian logismoi into the ‘deadly sins’ tradition, resulting in a category error. Acedia is more properly understood, not as a psychological state or a sin, but rather as an array of demonic temptations with the unifying end-goal of (...) interrupting the anchoritic ideal of sustained contemplation. The problem of 'no fault' compensation for patients who suffer adverse effects as a result of their participation in clinical trials is discussed in the light of the guidelines issued by the Association of the British Pharmaceutical Industry (ABPI) and our recent experiences in reviewing protocols submitted to the local ethics of surgical research sub-committee. We have found a variety of qualifications being applied by pharmaceutical firms which are not in the spirit of the guidelines, let alone the interests of (...) the patient, and we suggest a means whereby the patients can be assured of fair treatment in the event of 'no fault' injury. Many apparently complex mechanisms in biology, especially in embryology and molecular biology, can be explained easily by reasoning at the level of the “efficient cause” of the observed phenomenology: the mechanism can then be explained by a simple geometrical argument or a variational principle, leading to the solution of an optimization problem, for example, via the co-existence of a minimization and a maximization problem . Passing from a microscopic level to the macroscopic level often involves an averaging effect that gives (...) birth to a global functional feature . We will illustrate these general principles by building in four different domains of application “a minima” models and showing the main properties of their solutions: extraction of a minimal RNA structure functioning as the first “peptidic machine,” a kind of ancestral ribosome; study of a genetic regulatory network of Drosophila centred on Engrailed gene and expressing successively two genes inside a limit cycle; study of a genetic network regulating neural activity and proliferation in mammals; and study of a simple geometric model of epiboly in zebrafish.
